Update on LinkedIn “Skills & Expertise” Section for Florida Lawyers: Staff Opinion Likely to be Overturned

October 10, 2013

The Florida Bar’s Standing Committee on Advertising met earlier this week to discuss the staff opinion mentioned in my blog post from last week which held that Florida lawyers cannot list areas of practice under the “Skills & Expertise” Section of LinkedIn unless they are Board Certified (or the equivalent).  During yesterday’s meeting, the Committee agreed to convene a special meeting later this month focused solely on the question of the applicability of the Rules to LinkedIn endorsements.  I spoke with a member of the Committee today who indicated that there is a very good likelihood that the staff opinion will be overturned later this month.

The committee welcomes written comments regarding the application of the rules to LinkedIn.  If you’d like to comment, you can send your written comments to Elizabeth Tarbert, the Ethics and Advertising Counsel for The Florida Bar.

Stay tuned!
